The use of this web site is governed by the policies, terms and conditions set
forth below. Please read them carefully. Your use of this web site indicates
your acceptance of these terms and conditions. Your placement of an order
indicates your acceptance of these terms and conditions. Your submittal of any
purchase order to CaliforniaFrames.com indicates acceptance of these terms and
conditions. These terms and conditions shall supersede any subsequent terms or
conditions included with any purchase order, whether or not such terms or
conditions are signed by CaliforniaFrames.com . CaliforniaFrames.com reserves
the right to make changes to this site and these terms and conditions at any
time.
Disclaimer and Limitation of Liability as to
CaliforniaFrames.com site:
The CaliforniaFrames.com web site and the materials therein are provided as
is. CaliforniaFrames.com makes no representations or warranties, either express
or implied, of any kind with respect to the CaliforniaFrames.com site, their
operations, contents, information or materials. California Frames expressly
disclaims all warranties, express or implied, of any kind with respect to the
site or their use, including but not limited to merchantability and fitness for
a particular purpose. You agree that CaliforniaFrames.com, its directors,
officers, employees or other representatives shall not be liable for damages
arising from the operation, content or use of the CaliforniaFrames.com site. You
agree that this limitation of liability is comprehensive and applies to all
damages of any kind, including without limitation direct, indirect,
compensatory, special, incidental, punitive and consequential damages.
Changes to this
Agreement:
We reserve the right to modify this Agreement at any time without notice, and
you agree to be bound by such changes as soon as a new Agreement is posted to
the Website. We also reserve the right to deny your access to the Website if we
believe, in our sole discretion, that you have violated this Agreement, any
applicable law, or the rights of any third party.
Limited Warranty:
We want you to be satisfied with your purchase, and we warrant that, for a
period of 30 days, the products you purchase from the Website will be free from
defects in materials and workmanship. If you are not happy with your purchase,
call our customer service line to obtain a return authorization, and then simply
return your merchandise with this authorization number for an exchange or a
replacement for an identical picture frame or any other picture frame of the
same value.
Return and Refund Policy:
Returns are not accepted (except in cases of missing or defective products)
because all picture frames are custom made and manufactured for your specific
picture frame order. Sometimes if the picture frames can be resold to another
customer, a return may be considered. If a return order is accepted, a credit
will be placed on your account and a 20% restocking fee will apply. Please note
that shipping charges will not be refunded. No cash refunds will be made. Any
credits issued are for CaliforniaFrames.com merchandise only and must be used
within three months of the date issued. Return orders received without a return
authorization will be refused. The customer is responsible for packaging and the
return shipping charges. Returns must be made with the original shipping
materials.
Missing or Damaged
Merchandise:
You, the buyer, should contact us by phone or email immediately if you receive a damaged picture frame and if it was due
to mishandling by the US Postal Service, UPS, FedEx or any other carrier we use. You must
contact us within 24 hours of receipt of the damaged merchandise to
report a claim.
We will then file a claim with the corresponding carrier. Please keep all packaging materials
until claim has been settled. California Frames is
absolutely not responsible for damages to any picture
frame damaged on transit.
Defective Products, Goods and/or
Merchandise:
We must be notified of any defects in merchandise within
24 hours of receipt of goods. Replacements will
ship in 2 to 3 weeks for wholesale orders and 7 full business days for retail
orders. Please note that no cash refunds will be made for defective
products. Any
defective product will be replaced by a new and
identical product or part free of charge. "Closeout and
special frame sales" are not included and are sold AS
IS.
Request of Sample Moldings :
Because we accept no returns and we want our customers
to be satisfied with their purchases, we encourage the
use of our sample molding program. This will ensure that
when you receive your order, your expectations will be
met. We will send you, for $1.00 each, a 3" sample of
any type of molding that we carry-no limit. A shipping
charge via US Postal Service, First-Class Mail of $2.95 per sample order
will apply. Please contact our Customer Service

Credit Card Payments and Security:
For security reasons we, California Frames, can not see
your credit card details because our payment processors Paypal.com and
2checkout.com handles credit card payments. We only see
your name, address and the merchandise you ordered. Orders
paid for by credit card will be charged when the order
is placed to verify credit card and address information.
Cancelled Orders Terms:
Orders may not be cancelled anytime after production of
the order begins. If you want to cancel an order, you
must contact us by phone or email the same day that you placed the order.
Undeliverable and Refused Orders:
Please do not refuse an order. Refused shipments are
subject to a 20% restocking fee and shipping charges
will not be refunded.
Final Sales Terms and Conditions:
All sales of merchandise, goods and/or services shall be
final and payment in full shall be in accordance with
all other terms, conditions, and agreements included on
this page, and the credit application. No transaction
shall be construed to be a consignment of said goods
and/or services.
The person, company, or legal entity executing or
submitting an order is liable for any and all legal
fees, services, and/or costs arising out of or
associated with judgment rendered on behalf of
California Frames USA, Inc. should California Frames be
forced to initiate court action against applicant or
purchaser.
Privacy Policy:
Your privacy is taken very seriously because we hate spam as
much as our customers do. We, California Frames
, take our customers privacy very seriously and we won't give out,
trade or sell any customer's email addresses.
The information we
collect is used only for advertising of our products to the
customers who select that option after ordering our picture frames.
General:
This Agreement shall be governed by the laws of the state of California, and you
consent to the exclusive jurisdiction and venue of the state and federal courts
in California. If any provision of this Agreement is invalid or unenforceable,
the remaining provisions shall remain in force. Our failure to enforce any
provision of this Agreement does not waive our right to act with respect to
subsequent or similar breaches. This Agreement sets forth the entire
understanding and agreement between users and us of the Website with respect to
the subject matter hereof. If you do not agree with any of the terms of this
Agreement, please do not use the Website.
